And on the other hand, any natural person, not business person using website www.wubby.fr,
hereinafter referred to as the “Buyer”

ACCEPTATION OF GENERAL TERMS & CONDITIONS OF SALE (GTCS) :

The hereinafter contract governs the conditions under which Wubby products are sold, delivered and if necessary exchanged, or reimbursed. When ordering and using services available on Wubby website, the Buyer declares to have acknowledged and accepted the present General Terms & Conditions of Sale before placing order.
Wubby reserves the right to modify these Terms & Conditions of Sale at any time. In that case, the Terms & Conditions of Sale applicable will be the Conditions prevailing at the moment of the order placed by the Buyer. Should one or more provisions in these GTCS be rendered invalid subsequent to the application of a French legal provision or court ruling, the other provisions shall remain in force.

ARTICLES & PRODUCTS :

www.wubby.fr is a website presenting Wubby brand and products, including an online portal shop for Buyers.
Wubby products are sold according to the availability indicated on the product page. Pictures of products are not contractual.
Wubby products are entirely Made in France with lambskins and sheepskins of Quality “Merino” produced in France, Italy, Spain & Portugal, so subject to the European directive of REACH (Registration, Evaluation, Authorization and Restriction of Chemicals).
The “Merino” sheepskin is also called “Shearling”, it means that both side of the leather skin have been carefully tanned and hand finished by the artisan tanner, with the wool left on. Then all accessories made with this sheepskin don’t need to be lined. So the sheepskin accessories remain soft and comfortable : the suede side, soft and silky, and the wool fur side, smooth & warm.
To maintain sheepskin, use a soft brush to remove impurities or dust. You can also ventilate the product in the open-air.
To clean sheepskin in case of a spot on suede side or fur side, slightly clean it with a moistened soft sponge; don’t put the skin into water.

PRICES :

Prices of products are in Euro, including VAT, but they do not include the shipping costs, nor custom taxes for countries concerned. Wubby reserves the right to change prices without notice at any time. The prices applicable to the Buyer on order shall be those shown on the Site at the time of the Buyer’s confirmation order on site.

PAYMENT :

Only payments in Euro (or converted in Euro) are accepted. Payment proposed on the site is Paypal or International Credit Card.
PayPal respects international PCI-DSS standards (Payment Card Industry Data Security Standards) adopted by organizations who collect, register, process or submit information to credit card holders.
The Buyer guaranties that she/he’s allowed to use the credit card for payment. If the payment is rejected by the bank, Wubby will stop the shipment of the order.

DELIVERY :

Delivery service is assured by La Poste (french Post), in “Colissimo Recommandé” for delivery in France, and in “Colissimo International” for delivery in Swiss, and to European Community Members (28 countries).
The average total time of delivery is 5 to 10 working days maximum, depending on availability of products.
For countries outside European Community, delivery service is assured by DHL with a tracking number.
The average total time of delivery is 5 to 10 working days maximum, depending on :
- availability of products
- the destination,
- the custom delay, if product is submitted to a custom duty in the destination country,
and as soon as payment is confirmed by bank of the Buyer.

Shipping costs are calculated when the buyer is placing the order and giving information of delivery place.

ORDER / BILLING :

After making her/his selection of product(s), the Buyer will have to put the selected items in the virtual cart, that she/he will have to validate to have the order being definitively confirmed.
The Buyer declares to have acknowledged and accepted the present General Terms & Conditions of Sale before validating the order on the website.
When the Buyer transfers to website the details for delivery of her/his order, to website she/he must verify that the information is accurate. In the event of error in the addressee’s details, Wubby could not be held responsible for failure in delivery of order.
The Buyer then proceed for payment. The order is then completed. The Buyer receive by return a mail confirming that the order is in process.
The billing of the order is sent at the same time as product is shipped. Then the Buyer is informed of the shipment by mail and receive, when it is appropriate, a shipping number.

RIGHT OF WITHDRAWAL & RETURN

If the Buyer is a natural person, as a consumer he has the right to terminate the purchase for any reason, without explanation and without any penalty. The right of withdrawal is not allowed to legal persons (like companies, retailers, etc..) and to persons acting for their companies purposes related.
The conditions of the withdrawal period are provided by articles L.121-20 et L 121-16 of the French Consumer Code. The Buyer has a withdrawal period of fourteen (14) working days from the date of delivery of her/his order.
To exercise her/his right of withdrawal, the Buyer will have to send a letter to the following address :

or send an e-mail with the contact form on website or directly to the address : contact@wubby.fr indicating the number of the order or the article reference name.
Once received the cancellation notice, the Buyer will have to send the product back to address mentioned above, only if product is new and never worn, in its original packaging. Shipping costs of the return will be at the Buyer’s charge and the costs for the first shipment will not be refunded.
The delivery, until Wubby states the receipt, is entirely under the responsibility of the Buyer;
If the goods are damaged during transport, Wubby will give prompt notice to the Buyer;
Wubby is not responsible for damage, loss or theft of returned products.
For products returned intact, the Buyer will be fully reimbursed of the amount of article ordered, within fourteen (14) days following the date of reception of product to Wubby.
The Paypal account or Credit Card used previously for payment of order, will be refunded of the amount of product.

RETURN OF PRODUCT FOR EXCHANGE :

In the case of exchange for another size or colour, or for another product, Wubby is committed to satisfying its Buyer within the limits of available stocks.
If the right product for Buyer is available, the Buyer will have to send the product back to address mentioned above, only if product is new and never worn, in its original packaging. Shipping costs of the return will be at the Buyer’s charge. The shipping costs of second shipment will be at the charge of Wubby.
If the right product for Buyer is not available, the Buyer can exercise her/his right of withdrawal; See above paragraph RIGHT OF WITHDRAWAL & RETURN.

GUARANTEES :

All products sold on Wubby website are covered by a legal warranty of conformity as stipulated in the sections L.211-4 to L.211-14 of the French Consumer Code.

CUSTOMER IDENTIFICATION – DATA PROCTECTION :

To help identify the Buyer, the Buyer authorize Wubby to use “cookie” on her/his computer.

Wubby could not be held liable for any inconvenience or damages due to using internet, namely in the event of an interruption of the system, for any outside interference. In particular, any perturbation in the delivery of services or any external intrusion or presence of computer viruses will not engage the responsibility of Wubby.
In addition, any event due to force majeure, in regard of the jurisprudence of French Court of Cassation, relieves Wubby of any responsibility.
Wubby shall not be held responsible in case of data loss or files in the consultation of the site. Buyer must proceed to all backups necessary before the order is placed electronically.

INTELLECTUAL PROPERTY :

All the visual elements of website “www.wubby.com” are protected by copyrights of trademarks, designs and patents. Wubby does not grant any license or right other than visit the hereby Site. The reproduction of all or part of Wubby site is authorized only for purposes of information or for strictly personal and private use.
Any other use or such content without the prior, written authorization of Wubby, will constitute a forgery and could be penalized as such.

PARTIAL NON VALIDITY :

If a particular stipulation of these terms is held invalid or declared as such by a Court decision, other stipulations shall remain in force to their full extend.

JURISDICTION :

The hereby General Terms & Conditions of Sale (GTCS) are govern by the French law. Failing amicable agreement, that should be sought before any judicial remedy, any dispute concerning the interpretation, the execution or the breach of contract concluded between Wubby and the Buyer, even in the event of multiple defendants, will be under the exclusive competence of the Law Court of Paris.
